Acceptance of Terms
By using the GiftedX Learning Management System (“LMS”), you (“User”) agree to be bound by these Terms of Use (“Terms”).
These Terms govern your access to and use of the LMS and all content, materials, services, and software owned or licensed by GiftedX or Reasonix, as well as any third-party content made available through the LMS with permission.
If the User is a minor, the parent or legal guardian is responsible for ensuring compliance with these Terms.
Content & Intellectual Property
All content available through the LMS, including educational materials, videos, assessments, communications, and media, is owned by GiftedX or licensed third parties and is protected by intellectual property laws.
Users are granted a limited, non-exclusive, non-transferable license to access and use the content solely for personal, non-commercial educational purposes.
Third-Party Content
All third-party content remains the sole property of its respective owners. GiftedX is not responsible for third-party content but reserves the right to remove or restrict such content if it violates these Terms.
Acceptable & Prohibited Use , Users shall NOT:
- Use the LMS for unlawful or non-educational purposes
- Upload or share offensive, explicit, discriminatory, or harmful content
- Impersonate any individual or entity
- Attempt unauthorized access, hacking, or data mining
- Copy or distribute content without permission
- Collect personal data without consent
- Upload malware or harmful software
- Promote commercial or political activities without authorization
- Violate applicable laws or intellectual property rights
Login Credentials & Responsibility
Each user is assigned unique login credentials and is responsible for maintaining their confidentiality. Users are fully responsible for all activities conducted through their account and must notify GiftedX immediately of any unauthorized use.
Privacy
Use of the LMS is subject to the GiftedX Privacy Policy, which forms an integral part of these Terms.
Disclaimer of Warranties
The LMS and all content are provided “as is” without warranties of any kind. GiftedX does not guarantee uninterrupted or error-free operation.
Limitation of Liability
To the maximum extent permitted by law, GiftedX and Reasonix shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of or inability to use the LMS.
Termination
GiftedX reserves the right to suspend or terminate access to the LMS for violations of these Terms or for legal, security, or technical reasons, without liability.
Governing Law
These Terms shall be governed and interpreted in accordance with applicable laws, considering the cross-border digital nature of the platform.
